It is not always OK to drink alcohol on Fremont Street

LAS VEGAS (KSNV & MyNews3) -- With First Friday taking place tonight, there are a lot of questions about the rules of drinking alcohol on Fremont Street.

Thousands of locals and tourists make their way downtown for the monthly event.

News 3's Sergio Avila is live on Fremont east to break down the laws.

It is true you can you have open containers in that area but there are strict laws about this.

This has been the problem because this has been a gray area for visitors.

The Fremont Street Experience is one thing. It's privately owned and people can buy drinks outside the casinos and walk around with them with no problem.

That's only from Las Vegas Boulevard to Main Street on Fremont.
On Fremont East it's kind of different because you can't buy drinks on the street.

This is where it gets tricky.

You can buy a drink inside a bar and if they let you walk out with it or put it in a to-go cup for you, you're fine; you're not breaking the law.

What is against the law is if you bring your own alcohol, open it yourself and drink it on the streets.

DUI Attorney Garrett Ogata tells us that is absolutely illegal both at the Fremont Street Experience and Fremont East.

“Even when you buy from another place, a supermarket and you brown bag it from a supermarket or a 7/11 down the street and you bring your beer walking around Fremont under the canopy on the west side from LVB west on Fremont, that is not legal either. They’re not going to allow that, you have to buy your drink from one of the establishments,” Ogata said.

Metro has recently been cracking down on the open container law.

One of the reasons is that we've heard they're seeing far more underage kids coming up and having street parties especially during nights like First Friday.

So just remember, if you're planning to come out to First Friday, just make sure if you're drinking on the street that you buy it from a Fremont Street business.
