Martinez's resignation shakes up Metro's Use of Force board

LAS VEGAS -- There's been a shakeup tonight within Metro's Use of Force board the co-chairman today stepping down from his position, saying the process is flawed.

He also accuses Sheriff Doug Gillespie of bowing to the Police Protective Association.

Robert Martinez was the co-chairman of the use of force board until yesterday when he handed his resignation to the sheriff.

The use of force board is comprised of mostly civilians, but some former police as well.

Their job is to review use of force cases and make recommendations for possible punishment.

Under the guidelines the sheriff does have the final say and it was after the sheriff's decision to suspend officer Jacquar Roston that Martinez and others are now questioning the process altogether.

In November of last year Roston responded to a domestic violence call nd ultimately shot a man in the leg he thought was reaching for a weapon.

It turned out that man was trying to hide marijuana and he was actually reaching for a baseball cap. That person was "not" armed.

The Use of Force board unanimously recommended to the sheriff that roston be fired for his actions.

"I can't be part of this process when I know going in that ultimately in the end, to me, my own words, that the fix is in, that the deck is stacked against the board, and will always be stacked against the board.” Martinez said. “That no matter what the recommendation is of the board, the Sheriff, he gets to overturn it.”

Additionally, News 3 has learned that four other civillian members of the board have resigned. How the board moves forward from here is unclear. They'll have to be replaced obviously.

Also, News 3 did request an interview, statement or response of any kind from the the sheriff this morning on these developments but we have yet to hear back.
