LAS VEGAS (KSNV – Ammar Harris, the suspect in a deadly shooting and crash on the Las Vegas Strip, may be facing another felony charge.

Harris, who police say opened fire on the Strip on Feb. 21, 2013, setting off a chain reaction that killed three people, is being accused of having a cell phone smuggled to him in prison. If that allegation is proven to be true, that is a felony because a cell phone in prison is considered contraband.

Because of this issue, the Nevada Department of Corrections moved Harris from High Desert State Prison near Indian Springs to Ely State Prison, which is about four hours away.

Unfortunately, that makes it very difficult for Harris’ defense team to work with him while preparing for his murder trial, and they want him transferred to the Clark County Detention Center. It could cause a delay in his trial that is scheduled to begin in September.

“I do not see how it cannot (be delayed) because the access of them to prepare their client for a capital trial requires a lot of contact,” said prosecutor Dave Stanton. “And just the logistics between the attorneys getting out there, let alone the different people they have to have access to, and he is obviously in a high-security prison now. That is going to cause a delay just because I do not think they can prepare their defense.”
