DA says no charges coming in girl's accidental shooting death

LAS VEGAS (KSNV -- The Clark County district attorney’s office said Thursday that no charges will be filed in the shooting death of a 13-year-old Henderson girl at a friend’s residence.

Brooklynn Mohler was shot June 4 at the home in the 1600 block of Littlecrow Avenue, near West Pebble Road and Spencer Street and later died of her injuries.

Police said her friend was holding a gun when it accidently discharged.

Mohler's family had created a Facebook page demanding charges against the gun owner. Clark County District Attorney Steve Wolfson explained his reasoning in an exclusive interview with News 3 about the case.

“I do find that there was negligence here, but we don’t have a criminal negligence statute on the books,” he said. “The one statute that arguably applies talks about the willful conduct of somebody, and that somebody must willfully put somebody in a situation where he could suffer harm or, in this case, death.”

Wolfson says the parents who owned that gun will not face charges, and there was no evidence to suggest intent on the part of the shooter.

Friends of Brooklynn conducted a pair of memorial flag football games Thursday night at her former grade school, Neal Elementary. She was a student at Schofield Middle School at the time of her death.
